Houston Employer Retaliation Lawyer

Most companies have established policies and grievance procedures designed to safeguard employees’ right to report wrongdoing in the workplace. This could include reporting issues of sexual harassment, discrimination or fraudulent conduct. In some cases, however, employees find themselves the target of adverse action as a result of reporting problems in the workplace.

If you or someone you know has suffered unfair workplace retaliation, contact me, Houston employer retaliation attorney Peter Costea. I have represented employees’ rights since 1993. As an experienced trial lawyer, I have tried nearly 100 employment cases to verdict. While I will seek amicable resolutions where possible, I have the experience to defend your employment rights in court if necessary.

Skilled Attorney Protecting Employees’ Rights Against Hostile Work Environments

Retaliation can arise in a variety of contexts, not just in cases of reporting suspected or confirmed wrongdoing by other co-workers or executives. Some employees experience retaliation after filing a workers’ compensation claim, seeking FMLA leave or requesting disability accommodation. Employer retaliation can include:

  • Receiving a poor performance evaluation from a superior
  • Wrongful denial of workers’ compensation benefits or accommodation
  • Demotion
  • Wrongful termination of employment

Whatever the context of your circumstances, if you suffered job reprisals for making lawful requests or reporting known issues, I will aggressively protect your rights under appropriate state and federal job protection laws. This includes the Americans With Disability Act (ADA), the Family and Medical Leave Act (FMLA), the Dodd-Frank Act protecting whistleblowers’ rights, and other legislation.

As an example, I defended a client in Wilson v. Lone Star Ford in the 1990s who experienced unlawful retaliation after reporting an on-the-job injury and filing a workers’ compensation claim. A jury returned a verdict in favor of Mr. Wilson, and the court of appeals affirmed the jury verdict. The case eventually settled pending a hearing before the Texas Supreme Court.
